Conclusion of the contract
By sending a valid original prescription (Part 1 and Part 2) by post to the 360Grad pharmacy address specified in paragraph 11, the customer accepts a binding offer to purchase the prescription medication prescribed in the prescription (hereinafter referred to as a "medication order"). The online upload of the prescription and confirmation of acceptance of the offer ("Acknowledgement of Acceptance"), which occurs immediately prior to checking the prescription at the Pharmacy, does not constitute acceptance of the contract by checking the original prescription by sending a confirmation of dispatch ("Acknowledgement of Dispatch") by email or by delivery of the prescribed medication.
Before sending a medication order, the customer has the opportunity to view, print and save the general terms and conditions and the privacy policy.
All medication orders are subject to acceptance and availability. If the products you have ordered are not available, you will be notified by email (or other means if no email address has been provided). You then have the option to wait until the item is available again or cancel the medication order. The "live inventory" on the website may differ from the actual inventory in the pharmacy and does not purport to be complete.
We are entitled to refuse any medication orders placed by you at any time. A contract between you and us will be formed when (i) we charge your credit or debit card or (ii) we ship the goods or begin providing services to you (whichever is later). At this point we will send you an email confirming the dispatch and that the contract has been completed.
We take all reasonable steps to ensure the security of your medication order and payment details as far as we can. However, in the absence of negligence on our part, we will not be liable for any losses you may suffer if a third party gains unauthorised access to information you have provided when accessing or ordering medication through our website.
Products sold on the Site are for your use only and are not for resale or distribution. We reserve the right to cancel medication orders and/or suspend accounts if we believe that products are being ordered in violation of this provision.
Right of withdrawal
As our website only involves the payment of a prescription, the statutory right of withdrawal does not apply to goods or services.

Delivery
You are responsible for the delivery of the goods to the address you provided when ordering the medicine. We exclude liability if you have provided an incorrect delivery address or if you do not collect the goods from the delivery address you have provided.
Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. Delivery is made in accordance with the General Terms and Conditions of Deutsche Post AG (DHL).
The customer will receive an email confirming the dispatch of the package and containing a tracking number. The DHL shipping service provider will only hand over the prescription medication to the customer upon presentation of a valid national ID card to ensure proper delivery of the prescription medication.
At the customer's request, prescription drugs can be picked up at the pharmacy. Collection takes place at the following address:

The pharmacy will only hand over the prescription medication to the customer or authorised person at the time of collection upon presentation of a valid ID card, passport or other official identification documents to ensure proper handover of the prescription medication. The type and number of ID card shall be retained for later proof of proper execution. The information may only be used as proof of proper delivery of ordered medication.
Price and payment
(1) All prices displayed on the website include VAT at 19 % (if applicable) at the relevant rate and are correct at the time the information is entered into the system. However, we reserve the right to change prices at any time without notice.
A BtM fee of EUR 4,26 gross is charged for each medicinal product falling under Annex III of the BtM Act.
The customer will also be informed of any additional shipping costs prior to the conclusion of the contract.
Payments can be made by any standard credit or debit card, by purchase on account and on the spot (360Grad-Apotheke, Bonner Straße 237, 40589 Düsseldorf). The amount due will be debited from your account before the goods or services are dispatched. When you make transactions with your credit card, the amount of EUR 0.01 will be withheld until the card issuer has verified your payment.
In the unlikely event that the price displayed on the checkout page is incorrect and we discover this before accepting your order for medicines in accordance with clause 9, we will not be obliged to sell you the goods at the price displayed. We will always endeavour to ensure that the prices of the goods on our site are correct. However, occasionally errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the opportunity to confirm your medicine order at the correct price or cancel it. If you cancel a medicine order but have already paid for the goods (and if they have not yet been dispatched), you will be refunded the full purchase price.
You hereby confirm that you are the owner of the credit/debit card or bank account used. All credit/debit cards are subject to a validation check and authorisation by the card issuer. If your credit card issuer does not authorise payment to us or refuses to do so for any reason, we will not be liable to you for any delay or non-delivery.
Any legal disputes in connection with the processing of cards will be resolved in accordance with German law.
If your payment cannot be successfully processed by credit card (e.g. by direct debit or credit card), we reserve the right to try again. However, we will notify you at least 48 hours in advance by e-mail to your e-mail address. If you do not wish to attempt direct debit again, you should cancel your medication order within 48 hours of receiving the email.
In the case of an order for medication on account, the pharmacy will forward the invoice issued to the customer to the designated debt collection service provider. If the pharmacy's receivable is not paid despite a previous reminder, the receivable will be collected directly by the debt collection service provider.

Multiple collections can be notified in advance. The time limit for sending advance notification is reduced from 7 days to one day. This is done by providing the relevant information on the invoice or by electronic data transmission (together with the information on the invoice).

Prescription drugs supplied remain the property of 360Grad Pharmacy until all existing claims against the customer have been settled in full.
Limitation of liability
We shall only be liable to the customer without limitation in accordance with the statutory provisions for damages to life, body and health and in accordance with the Product Liability Act, as well as for all damages that are based on intentional or grossly negligent breach of contract and are limited to damages that are normally related to the contract, connected and foreseeable. Any further liability on our part shall be excluded regardless of the legal nature of the claim asserted; this applies in particular to tort claims or claims for compensation for lost expenses in lieu of performance.
The Website is provided on an "as is" and "as available" basis. In the event of defects, consumers are subject to statutory warranty rights. No representations or warranties, express or implied, are made in connection with the Website and its use. You acknowledge that we cannot guarantee or be responsible for the security or privacy of the Site or any information you provide. You bear the risk associated with your use of the Internet.
Whilst we endeavour to ensure that the material on the website is accurate, trustworthy and of high quality, we cannot accept liability if this is not the case.
